According to Plaintiff’s First Amended Complaint, Soprema allegedly supplied roofing materials for the Queens’ MarketPlace project. Defendants Beachside and A-1 Master Roofing, both located in Hawaii, installed the materials per their written Authorized Roofing Agreements with Soprema. After installing the roofing systems, Soprema allegedly discovered that the roofs did not properly adhere to the construction specifications. As a result, ten buildings had catastrophic roof leaks. In response, Queens’ Market withheld two million dollars owed to Bodell until Soprema issued a warranty on the roofs.

Soprema alleges that it incurred unpaid testing, supervision and inspection fees as well as costs for mediation of the roofing issues. Plaintiff further alleges that the mediation and subsequent efforts to remediate the alleged faulty roofing system occurred in Hawaii.
